This document aims to establish the Terms and Conditions under which you (hereinafter “The User”) may use this website (hereinafter the “Site”) owned by OPERADORA HOTELERA BRISAS, S.A. DE C.V., (hereinafter “OHB”). These Terms and Conditions constitute a binding agreement between OHB, the holder of all rights to the Site. Therefore, it is recommended that you read these Terms carefully.
SIMPLY USING THE SITE IMPLIES FULL ACCEPTANCE BY THE USER OF THESE TERMS AND CONDITIONS. IF YOU DO NOT ACCEPT THESE TERMS AND CONDITIONS OR ANY PART THEREOF, YOU SHOULD NOT USE THE SITE, AND IF THIS IS THE CASE, PLEASE REFRAIN FROM DOING SO. The user will be fully responsible for any damage or loss caused to OHB as a result of using the Service in violation of any provision set forth in these Terms of Use, and agrees to hold OHB and/or its affiliates or subsidiaries, its administrators, staff, agents, and representatives harmless from any liability they may incur as a result of such a violation by the user, as well as from any claim, lawsuit, or legal action that may arise against OHB as a result of the described actions and, in general, from any claim, lawsuit, or legal action derived from the use of the Site.
GENERAL TERMS OF USE OF THE SITE.
OHB provides the User with access to and/or the use of a range of online resources and content via the Internet, including, but not limited to: online texts, event information, contact details, maps, promotions, trivia, image and video galleries, among others, through the Site.
OHB reserves the right to modify, add, or remove the Site, as well as the conditions required to access and/or use it, at any time and without prior notice, except as stated in the respective Privacy Notice.

INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS OF THE SITE AND USER CONTRIBUTIONS TO THE SERVICE.
The information contained on this website is the exclusive property of OHB. This information is confidential and may not be copied, distributed, disclosed, or revealed without the prior written authorization of OHB.
It is prohibited to use and/or reproduce in whole or in part the information contained on the site through any verbal, written, or graphical means (mechanical or electronic), known or yet to be known, in any form or for any purpose, without the prior express written authorization of OHB. Any use and/or reproduction of the information contained on this site without OHB’s authorization may constitute a violation of applicable Mexican laws.
The information on this site contains various trademarks, which are the exclusive property of OHB, such as: LAS BRISAS®, LAS BRISAS (and Design) ®, among others, which are valid and protected under the Industrial Property Law.
In the event of a breach of any of the above provisions, OHB has the right to take legal or administrative action, claims, complaints, and other legal proceedings as deemed appropriate, in addition to seeking compensation for damages.
PROHIBITED CONDUCT.
The User acknowledges and agrees that OHB may (but is not obligated to) review the content that is posted and, if necessary, delete or refuse to post it online.
The User agrees that they are solely responsible for the content they post on the Site or transmit to other Users. By posting content on any area of the Site, the User assures and guarantees that they have the right to grant OHB an irrevocable, perpetual, non-exclusive, worldwide, fully paid-up license to reproduce, distribute, publicly display, perform, or otherwise use the Content, and to create derivative works or incorporate the Content into other works, as well as grant sublicenses for all of the above.
The User declares that they will not post illegal or prohibited content and will not violate, misappropriate, infringe, or contravene any third-party rights (including, but not limited to, any intellectual and personal property rights) on the Site.
The User agrees to refrain from any conduct that infringes upon the rights of others while using the Site.
In particular, and without limitation, the User agrees to refrain from the following while using the Site:
- Not to introduce or disseminate content that is racist, xenophobic, pornographic, promotes terrorism, or infringes upon human rights.
- Not to introduce or spread programs (viruses or malicious software) that could damage the systems of the access provider, its suppliers, or third-party users of the internet network.
- Not to disseminate, transmit, or make available to third parties any information, element, or content that infringes upon fundamental rights and public freedoms recognized by the Constitution and international treaties.
- Not to disseminate, transmit, or make available any type of illegal or unfair advertising.
- Not to transmit unsolicited or unauthorized advertisements, promotional material, “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation, except in designated areas (such as commercial spaces) specifically meant for that purpose.
- Not to introduce or spread false, ambiguous, or inaccurate information that may mislead the recipients.
- Not to impersonate other users by using their registration keys for various services and/or content on the Portals.
- Not to disseminate, transmit, or make available to third parties any information, element, or content that constitutes a violation of intellectual and industrial property rights, patents, trademarks, or copyrights belonging to the Portals or third parties.
- Not to disseminate, transmit, or make available to third parties any information, element, or content that violates communication secrecy or personal data protection laws.
In the event of a violation of these Terms and Conditions by the User, OHB may immediately deny or withdraw access to the Site.
CONSENT.
The User, being fully capable under applicable Mexican law, expressly consents to be bound by the content and scope of these Terms and Conditions of Use. Therefore, the User acknowledges and agrees that each time they use the Site, they reaffirm and confirm their consent to this agreement and/or the latest version of the same.
PERSONAL DATA.
In some cases, within the Site, the User may be explicitly requested to provide personal information (hereinafter “Personal Information”), such as name, address, email, phone number, etc. This information is necessary for the User to access certain features of the Site.
OHB is not responsible for the accuracy of the information provided, as it comes directly from the users accessing this website.
Additionally, OHB reserves the right to exclude from the use of the Site any user who has provided false data, without prejudice to any other actions that may be taken under the law.

OHB considers personal information to be private and confidential, and stores it in a secure location, accessible only to personnel specifically designated by OHB, and used exclusively for the purposes for which it was provided. APPLICABLE LAW AND JURISDICTION.
By using the Site, the User expressly agrees to submit, in case of any dispute, to the jurisdiction of the competent courts of Mexico City, and to the applicable laws in force at that location, expressly waiving any other jurisdiction that may correspond due to their nationality or domicile.
